Terms and Conditions
1. Introduction
This document outlines the terms and conditions (“Terms”) governing the membership, participation, collaboration, and activities related to the Worldwide Empowering Fashion and Designers Association (WEFDA). Headquartered in Vancouver, Canada, WEFDA is a global, non-profit organization dedicated to supporting, promoting, and empowering fashion designers, businesses, and associated industries, particularly those with Eurasian heritage or interests.
By becoming a member, partner, or participant in any of WEFDA’s activities, events, or collaborations, you agree to abide by the following terms, which are legally binding and serve to protect WEFDA’s mission, members, intellectual property, and operational integrity.
2. Scope of Applicability
These Terms apply to:
- Fashion Designers: Individuals and entities creating original fashion designs and collections.
- Fashion Businesses: Companies engaged in fashion manufacturing, retail, wholesale, marketing, and distribution.
- Service Providers: Including but not limited to media, PR firms, consultants, legal advisors, financial institutions, and other service entities working in the fashion industry.
- Partner Organizations: Including fashion houses, industry associations, government agencies, cultural organizations, and international bodies partnering with WEFDA on global initiatives.
- Supporting Industries: Textile manufacturers, accessory producers, logistics companies, technology providers, sustainability advisors, and other industries that interact with fashion businesses.
- Collaborators and Investors: Entities or individuals engaged in funding, supporting, or collaborating with WEFDA or its members.
3. Membership and Partnership
3.1 Membership Eligibility
- Designers and Fashion Houses: Professional designers, fashion brands, or fashion houses may apply for membership. International designers, particularly from the Eurasian region, are encouraged to apply.
- Fashion Businesses: Companies involved in fashion production, retail, or distribution.
- Service Providers and Partner Organizations: Businesses offering services directly to the fashion industry or supporting WEFDA’s global initiatives.
3.2 Membership Categories
- Full Membership: Available to established designers, fashion houses, and businesses with a proven track record in the fashion industry.
- Associate Membership: For emerging designers, student members, or those new to the industry.
- Corporate Membership: For businesses engaged in partnerships, supply chains, or ancillary industries related to fashion.
- International Membership: For designers and businesses operating outside Canada but involved in activities that align with WEFDA’s mission.
- Supporting Membership: For organizations or individuals providing sponsorship, financial support, or advisory roles.
3.3 Partnership Agreements
- WEFDA may enter into formal partnerships with international associations, trade organizations, government bodies, cultural institutions, and private corporations to promote fashion and design on a global scale.
- Partnerships are subject to a formal agreement outlining the scope, responsibilities, and mutual expectations of each party.
3.4 Application Process
- All prospective members and partners must submit an application detailing their background, portfolio, services provided (if applicable), and a statement of intent regarding their collaboration with WEFDA.
- Applications are subject to review and approval by WEFDA’s Board of Directors. WEFDA reserves the right to accept or reject any application without the need to provide justification.
3.5 Membership and Partnership Fees
- Membership and partnership fees are structured according to the applicant’s category (e.g., individual, corporate, or partner). Fees are reviewed annually and are payable upon approval of the application.
- Memberships will be revoked if dues are not paid within the stipulated period.
3.6 Membership and Partnership Obligations
- Members and partners are required to:
- Adhere to WEFDA’s ethical guidelines and promote the association’s mission.
- Participate actively in WEFDA events, programs, and initiatives.
- Respect the cultural values of Eurasian heritage and promote inclusivity and sustainability in their work.
- Maintain confidentiality of any sensitive information disclosed by WEFDA or other members.
3.7 Termination of Membership or Partnership
- WEFDA reserves the right to terminate any membership or partnership for reasons including, but not limited to:
- Violation of WEFDA’s policies or ethical standards.
- Failure to meet financial obligations (e.g., membership fees, event fees).
- Engaging in actions that damage the reputation of WEFDA or its members.
- Non-participation or inactivity for over 12 months.
4. Intellectual Property Rights
4.1 Ownership of Intellectual Property
- Members, partners, and collaborators retain full ownership of their designs, trademarks, and other intellectual property.
- By participating in WEFDA-organized events, exhibitions, or collaborations, members grant WEFDA a non-exclusive, royalty-free license to use images, designs, and materials for promotional purposes, both within Canada and internationally.
4.2 Protection of Intellectual Property
- WEFDA does not assume responsibility for protecting members’ intellectual property from infringement by third parties but will assist in providing guidance on legal recourse in case of violation.
- Members are encouraged to protect their intellectual property through appropriate channels (e.g., registering trademarks, patents, or copyrights) in all jurisdictions in which they operate.
4.3 Collaborative Work
- In cases of collaborative work or joint projects facilitated by WEFDA, parties involved must enter into written agreements clarifying the ownership, licensing, and distribution of intellectual property.
- These agreements should include provisions on revenue sharing, royalties, and control over the use of collaborative works.
4.4 Use of WEFDA’s Intellectual Property
- Members and partners may not use WEFDA’s name, logo, or branding materials without express written consent. Unauthorized use may result in legal action or termination of membership.
5. Ethical Standards and Code of Conduct
5.1 Professional and Ethical Conduct
- All members, partners, and collaborators must adhere to the highest standards of professional integrity. WEFDA fosters a culture of inclusivity, innovation, and mutual respect.
- Acts of discrimination, harassment, unethical behavior, or exploitation of labor will not be tolerated and may result in immediate termination of membership or partnership.
5.2 Sustainability and Environmental Commitment
- WEFDA is committed to promoting environmentally sustainable practices in the fashion industry. Members and partners are expected to:
- Reduce environmental impact by adopting sustainable practices in production, supply chain management, and material sourcing.
- Ensure fair and ethical labor practices in all aspects of their business operations.
- WEFDA may periodically assess members’ and partners’ compliance with these commitments and offer support for improving sustainability measures.
5.3 Cultural Sensitivity
- Members and partners must be aware of and respect cultural heritage, particularly when incorporating elements of Eurasian fashion into their designs. Cultural appropriation without proper understanding or permission is strictly prohibited.
6. Event Participation and Activities
6.1 Invitations and Eligibility
- Members and partners are invited to participate in a wide range of WEFDA events, including but not limited to fashion shows, exhibitions, networking events, international trade fairs, workshops, and digital showcases.
- Participation in events is subject to application and approval by WEFDA’s event committee.
6.2 Event Fees
- Event participation fees may apply and vary depending on the event scale, location, and format. Members and partners are responsible for covering their own travel, accommodation, and shipping expenses unless otherwise specified.
- Event fees must be paid in full prior to participation. Failure to do so may result in disqualification from the event.
6.3 Liability and Insurance
- WEFDA assumes no liability for damages, losses, or theft of goods or materials at events. Members and partners are strongly encouraged to procure their own insurance coverage for all events, whether domestic or international.
6.4 Event Compliance
- Participants must comply with all local laws and regulations governing events, including intellectual property protection, labor laws, and health and safety regulations.
7. International Collaborations and Activities
7.1 Cross-Border Initiatives
- WEFDA actively facilitates cross-border collaborations between designers, businesses, and institutions. International members and partners must comply with all relevant import/export, trade, and intellectual property laws in the countries in which they operate.
- WEFDA may provide guidance or support in navigating international legal and regulatory landscapes but does not assume responsibility for members’ compliance with local laws.
7.2 Partnership with International Bodies
- WEFDA may enter into agreements with international fashion councils, trade bodies, and governmental organizations to expand opportunities for its members globally. These agreements may include joint events, exhibitions, and trade delegations.
- Such partnerships will be governed by separate agreements that define the rights and responsibilities of all parties involved.
7.3 International Event Participation
- For international events organized by WEFDA or its partners, members and collaborators are responsible for securing the necessary visas, permits, and shipping documentation. WEFDA will provide assistance where possible but is not liable for any legal or administrative complications that arise.
8. Privacy and Data Protection
8.1 Data Collection
- WEFDA collects and processes personal and professional information from members, partners, and event participants for the purposes of membership management, event coordination, and networking facilitation.

8.2 Use of Member and Partner Content
- Members and partners agree to allow WEFDA to use their logos, images, designs, and promotional materials for the purposes of marketing and promoting WEFDA events, activities, and collaborations.
- Any personal data shared for collaborative projects, media exposure, or networking will be used strictly for those purposes, with explicit permission from the data owners where required.
- WEFDA will not sell or share personal information with third parties without the express consent of the individual or entity, except where required by law.
8.3 Data Access and Deletion
- Members, partners, and collaborators have the right to access their personal data held by WEFDA. Requests for access or updates can be submitted in writing to WEFDA’s administration team.
- Members and partners may also request the deletion of their data upon termination of membership or partnership. WEFDA will comply unless the data is required to be retained for legal or accounting purposes.
9. Dispute Resolution
9.1 Mediation and Arbitration
- In the event of a dispute arising between WEFDA and a member, partner, or collaborator, both parties agree to attempt resolution through mediation before escalating the issue to legal channels.
- If mediation is unsuccessful, the matter may proceed to arbitration, with each party bearing its own legal costs. The arbitrator’s decision will be final and binding.
- Arbitration will be conducted in Vancouver, Canada, under the rules of the British Columbia International Commercial Arbitration Centre (BCICAC).
9.2 Governing Law
- These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada. Any disputes that cannot be resolved through mediation or arbitration will be subject to the jurisdiction of the courts of British Columbia, Canada.
- International partners and members must also comply with local laws in the jurisdictions where they operate. WEFDA assumes no responsibility for legal issues arising from non-compliance with foreign laws.
9.3 Conflict of Interest
- Members and partners are required to disclose any potential conflicts of interest that may arise in their dealings with WEFDA. Failure to disclose conflicts of interest may result in disciplinary action, including termination of membership or partnership.
10. Amendments to Terms and Conditions
10.1 Periodic Review
- WEFDA reserves the right to review and amend these Terms periodically to ensure compliance with changing legal, operational, and market conditions. Significant changes will be communicated to all members and partners in writing.
10.2 Member and Partner Notification
- Members and partners will be notified of any material changes to these Terms at least 30 days in advance of their effective date. Continued participation in WEFDA’s activities after the effective date will constitute acceptance of the updated Terms.
10.3 Acceptance of Changes
- If a member or partner does not agree with the amendments, they may terminate their membership or partnership in accordance with the procedures outlined in Section 3.7. Failure to accept the updated Terms will result in automatic termination of membership or partnership.
11. Financial and Commercial Responsibilities
11.1 Payment of Fees
- All membership, partnership, and event participation fees must be paid on time, as stipulated in invoices issued by WEFDA. Late payments will incur penalties, and failure to settle accounts may lead to suspension of privileges, such as participation in events or access to WEFDA resources.
- WEFDA may terminate memberships or partnerships if financial obligations are not met within the grace period specified in written notices.
11.2 Refund Policy
- Refunds for event participation fees or membership fees are not granted unless in exceptional circumstances approved by the WEFDA Board. Requests for refunds must be made in writing and will be evaluated on a case-by-case basis.
- In the event of event cancellations due to unforeseen circumstances (such as natural disasters, pandemics, or political unrest), WEFDA will endeavor to reschedule or provide alternative arrangements. No refunds will be given for cancellations beyond WEFDA's control.
11.3 Sponsorship and Funding
- WEFDA may accept sponsorships, grants, or donations from individuals, corporations, or government entities to support its activities. Sponsors will be acknowledged appropriately in line with agreements made between WEFDA and the sponsor.
- Sponsorship agreements must be consistent with WEFDA’s values, and WEFDA reserves the right to reject sponsorships that conflict with its mission or ethical standards.
12. Corporate Social Responsibility (CSR) and Global Initiatives
12.1 Social Impact and Fair Trade
- WEFDA is committed to advancing corporate social responsibility (CSR) within the fashion industry. Members and partners are encouraged to adopt fair trade practices, ensure workers’ rights, and support initiatives that contribute to positive social impacts in the communities where they operate.
- WEFDA will prioritize partnerships and collaborations with organizations that share its commitment to responsible business practices, including diversity, inclusion, and gender equality.
12.2 Environmental Sustainability
- In line with global sustainability goals, WEFDA encourages all members and partners to minimize their environmental footprint. This includes reducing waste, using sustainable materials, and employing ethical supply chains.
- Members and partners are expected to make continuous efforts to improve sustainability in their business operations and participate in WEFDA’s global sustainability initiatives.
12.3 Global Outreach Programs
- WEFDA will actively participate in and lead global outreach programs aimed at promoting fashion innovation, cultural exchange, and sustainability. Members and partners are invited to contribute to these programs through expertise, financial support, or participation.
- WEFDA may collaborate with international development organizations, NGOs, and governments to implement fashion-related projects that promote education, economic empowerment, and sustainability.
13. Disclaimer of Liability
13.1 General Disclaimer
- WEFDA does not guarantee the financial or commercial success of its members, partners, or collaborators. Participation in WEFDA’s events and programs is intended to provide exposure, networking opportunities, and educational resources, but outcomes are the sole responsibility of participants.
- WEFDA disclaims any liability for damages arising from business or financial losses incurred by members or partners, whether directly or indirectly related to their involvement in WEFDA activities.
13.2 Third-Party Relationships
- WEFDA is not responsible for the actions or conduct of third parties, including other members, event participants, sponsors, or partners, who may interact with WEFDA’s members. Members and partners are responsible for conducting due diligence in their business relationships.
13.3 Force Majeure
- WEFDA is not liable for any failure to perform its obligations under these Terms due to circumstances beyond its control, including but not limited to natural disasters, wars, government actions, labor strikes, pandemics, or disruptions to global supply chains.
14. Miscellaneous Provisions
14.1 Severability
- If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
14.2 Entire Agreement
- These Terms constitute the entire agreement between WEFDA and its members or partners. Any previous agreements, representations, or understandings, whether written or verbal, are superseded by these Terms.
14.3 No Waiver
- Failure by WEFDA to enforce any provision of these Terms shall not be deemed a waiver of the right to enforce that provision in the future.
14.4 Language
- These Terms are drafted in English. In the event of any discrepancy between the English version and a translated version of these Terms, the English version shall prevail.
By agreeing to these Terms and Conditions, members, partners, and collaborators confirm their commitment to the mission and ethical standards of the Worldwide Eurasian Fashion and Designers Association and acknowledge their understanding of the rights, responsibilities, and protections set forth in this document.
